3. Information We Collect

3.1 Information You or Your Organization Provide

  • Account & Business Info: Name of your business, division using our Products, business address, and relevant financial or tax details needed for consulting and HR services.
  • Contact Details: Name, work email, phone number, job title/position.
  • Payment Information: If you pay for our services, we or our payment processor (e.g., Stripe) collect credit card or bank info.
  • Employee Data (HR Services): If your employer uses our HR AI features, we may process employee details like name, work contact info, job function, salary range, demographic info (e.g., age group, gender, ethnicity), and any other data your employer submits. We handle this under instructions from your employer.

3.2 Information from Website Visitors

If you visit our marketing pages or fill out a “learn more” form, we might collect your name, email, phone number, organization, and reasons you’re interested in Atlas UP. We use this to respond to your inquiry and share more information about our Products.

3.3 Automatically Collected Information

When you interact with our Sites or Products, we collect:

  • Device & Browsing Data: IP address, browser type, operating system, device identifiers, pages visited, and usage times.
  • Cookies & Similar Technologies: We use cookies, web beacons, pixels, and similar tools to remember your preferences, analyze site traffic, and help with marketing (see Cookies and Advertising for more details).

3.4 Third-Party Sources

We may receive information about you from single sign-on providers or social media platforms if you choose to connect them with your Atlas UP account. We handle such data according to this Privacy Policy.

4. How We Use Your Information

We use personal information for the following purposes:

  1. Providing Our Services: Setting up and maintaining your account, delivering AI-driven consulting, facilitating HR insights, and processing payments.
  2. Improving Our Products: Analyzing usage patterns and feedback to enhance features, fix bugs, and inform product development.
  3. Communication: Sending service updates, transactional emails, security alerts, and—if you opt in—marketing messages about new features or special offers.
  4. Fraud Prevention & Security: Verifying accounts, investigating suspicious activities, and enforcing our Terms of Service.
  5. Legal & Compliance: Meeting obligations under applicable laws (e.g., tax rules) or responding to lawful requests from authorities.
  6. Analytics & Research: Aggregating and de-identifying usage data to understand user behavior, shape future product direction, and produce benchmarks.
  7. Marketing: Displaying relevant ads or sending promotional materials, subject to your preferences (see Your Choices).

AI Data Usage & Model Training

  • Limited AI Sharing: When you query our AI with your organizational data, we may route pseudonymized or aggregate information to third-party AI services (including OpenAI, Anthropic, and Google) under strict contractual terms to generate answers. These providers cannot use your data to train their public models or otherwise retain it for their own purposes. We strictly control how and when your data is transmitted to ensure confidentiality.
  • Internal AI Improvements: We may internally refine our AI by analyzing usage patterns in anonymized or aggregated form, ensuring no personal or proprietary data is exposed to other users or external AI systems. We do not train public-facing AI models with your raw data.

5. Data Retention

We retain personal data only as long as necessary to:

  • Provide and improve our Products;
  • Comply with legal obligations (e.g., audits, financial records);
  • Resolve disputes;
  • Enforce our agreements.

After these purposes are fulfilled, we securely delete or anonymize personal data. Specific retention durations may vary by data type (for instance, certain business or HR records may be kept for regulatory compliance). If you request deletion (and if no legal requirements prevent us), we’ll remove your personal data from active systems and archives within a reasonable timeframe.

6. How We Share Your Information

We do not sell your personal information. We only share your data under these circumstances:

  1. Service Providers (Agents): We rely on reputable third parties—like hosting providers (e.g., AWS), payment processors (e.g., Stripe), analytics platforms, and **AI API providers (such as OpenAI, Anthropic, and Google)**—to help run Atlas UP. Each is contractually required to use your data only for the services we request and to implement robust security measures.
  2. With Your Organization: If your employer set up your Atlas UP account, they can view data or usage details relevant to company-wide HR or analytics.
  3. As You Permit: If you request an integration or explicitly ask us to share certain data with a partner, we will do so with your permission.
  4. Legal Compliance: We may disclose information if required by court order, law, or when it’s necessary to protect our rights, safety, or property.
  5. Corporate Transactions: In mergers, acquisitions, or similar transactions, your data may be transferred, but any successor is bound to respect this Privacy Policy’s standards.
  6. Aggregated/Anonymized: We occasionally compile and share non-identifiable data for overall insights (e.g., “80% of users run monthly HR reports”), which cannot be traced back to you.

7. Cookies and Advertising

Cookies & Tracking: We use cookies and similar tech to recognize you, personalize your experience, and analyze how you navigate our Sites. Some are essential (e.g., session cookies that keep you logged in), while others support analytics or marketing.

  • Analytics: Tools like Google Analytics help us see usage patterns (e.g., pages viewed, time spent). Data gathered is typically aggregated and does not identify you personally.
  • Advertising: We may show Atlas UP ads on other sites or social media platforms. In some cases, third-party ad networks set cookies to track user activity across sites for interest-based advertising. You can learn more or opt out via resources like the Network Advertising Initiative or your browser’s privacy settings.

Your Cookie Choices: You can manage or delete cookies in your browser settings. Disabling cookies may limit some site features. Our Sites do not respond to “Do Not Track” signals, but we honor applicable opt-out requests under privacy laws (e.g., CCPA “Do Not Sell/Share” requests).

8. Your Privacy Rights

8.1 Access, Correction, and Deletion

  • Access/Portability: You can request a copy of the personal data we hold about you.
  • Correction: If your info is inaccurate or outdated, let us know—or update it in your account settings—and we’ll fix it.
  • Deletion: You can request we delete your data. We’ll honor this unless retention is legally required (e.g., financial records).

8.2 Marketing & Communication Preferences

  • Opt-Out: Unsubscribe from promotional emails by clicking the “unsubscribe” link or emailing us. We’ll still send essential service or security notices.
  • Do Not Sell/Share: We do not sell personal data. If you believe certain data sharing counts as “selling” or “sharing” under applicable law (like CCPA), contact us and we’ll ensure it stops.

8.3 Non-Discrimination

We won’t deny you services, change prices, or alter your experience just because you exercise these privacy rights. We respect your choices and aim to accommodate requests swiftly.

How to Exercise: Email support@atlasup.com. We may verify your identity before fulfilling your request—like confirming details we already have on file. If your employer is the account owner, we may need to coordinate with them first.

9. Security and Breach Notification

We work hard to protect your data:

  • Secure Hosting: We use encrypted, SOC 2-compliant cloud infrastructure with strict physical and network safeguards.
  • Encryption: Data is encrypted at rest and in transit (HTTPS/TLS).
  • Access Controls: Our staff can only access data on a “need to know” basis, with strong authentication in place.
  • Monitoring: We run vulnerability scans, security testing, and maintain a formal incident response process.
  • Employee Training: Everyone at Atlas UP is trained on data protection best practices and confidentiality.

Breach Notification: If we learn of a data breach that compromises your personal information, we’ll alert you or your organization promptly, consistent with applicable laws (e.g., HIPAA breach rules if relevant). We’ll also coordinate with legal counsel and notify regulators as required.

Monitoring & Vendor Oversight: When we use third-party AI providers (like OpenAI, Anthropic, or Google) to process a query, we enforce encryption in transit and maintain logs to ensure your data is never stored in an unapproved manner. If a security event occurs within these services, we will follow our incident response plan and notify you as required by law.

10. Forums, Testimonials, and Social Media

  • Forums & Events: If we host forums, events, or webinars, information you post there is public. Please be careful sharing personal or sensitive info in public spaces.
  • Testimonials: We may display customer stories or reviews. We’ll ask your permission before posting personally identifiable details or photos.
  • Social Media: Our Sites may have social media widgets (e.g., Facebook, LinkedIn). Your interactions with them are governed by each platform’s privacy rules.

11. Special Considerations (HIPAA & State Laws)

  • HIPAA: Though we generally do not handle PHI, if we sign a Business Associate Agreement with a healthcare provider, we follow HIPAA rules for any protected health information, including notifying the covered entity of breaches without unreasonable delay.
  • State Privacy Laws: If you’re a resident of a state with specific privacy laws (e.g., California CCPA/CPRA, Virginia CDPA), you have rights to request details about your personal information and to opt out of certain processing. We’ve incorporated these rights in Your Privacy Rights. Contact us if you have specific questions.

12. Children’s Privacy

Atlas UP’s Products are not intended for children under 13 (or the age of majority in your jurisdiction). We don’t knowingly collect data from minors. If we discover we’ve collected personal info from a minor, we’ll delete it promptly. Parents or guardians with concerns should email support@atlasup.com.

13. Changes to This Privacy Policy

We may update this Privacy Policy to reflect new features, legal requirements, or best practices. When we do, we’ll:

  • Update the “Last Updated” date.
  • Post a notice on our website if changes are significant.
  • Offer an opt-out or consent opportunity if legally required.

We encourage you to review this Policy periodically. By continuing to use our Products after updates, you accept the revised Policy unless your explicit consent is required by law.

14. Questions or Concerns?

If you have any questions about this Privacy Policy, your personal data, or if you believe we haven’t adhered to this Policy, please contact us at support@atlasup.com. We’ll do our best to address your concerns or resolve any issues promptly.

Thank you for trusting Atlas UP with your data. We commit to using it responsibly and securely as we help you power your business with AI.
